Eminent Domain Lawyer Explains Rights What To Consider As Pipeline Is Proposed To Cut Through Central Texas

Eminent domain lawyer explains rights, what to consider as pipeline is proposed to cut through Central Texas

Landowners in path of proposed Permian Highway Pipeline should understand their property rights, attorney says

AUSTIN, Texas (KXAN) — Many landowners in Central Texas are facing a new reality as a proposed 430-mile crude oil pipeline from West Texas to the Texas Gulf Coast cuts right through their property.

The Permian Highway Pipeline is currently in the permitting phase, but if approved, the 36-inch diameter pipeline would carry up to 2 million barrels of crude oil per day from the Permian Basin in West Texas to refineries along the Gulf Coast.

The route

The proposed route starts in Wink, Texas, and cuts diagonally across the state through 10 counties, crossing more than 100 rivers, streams and creeks, before ending near Freeport, Texas.

The pipeline would also come within a half-mile of more than 100 public schools and daycares.

What is eminent domain?

Eminent domain is the right of a government or a company with the government’s permission to take private property for public use so long as the owner is fairly compensated.

This power is most often invoked when there is a compelling public interest, such as building a highway or a school.

What are the rights of landowners?

Landowners whose property is in the path of the Permian Highway Pipeline have several rights, including:

  • The right to be notified of the proposed taking.
  • The right to negotiate with the pipeline company over the amount of compensation.
  • The right to a fair trial if they cannot reach an agreement with the pipeline company.

Landowners should also be aware that they are not required to sell their property to the pipeline company. They can also choose to fight the taking in court.

What should landowners consider?

Landowners who are facing the potential taking of their property by eminent domain should consider several factors, including:

  • The value of their property.
  • The impact of the pipeline on their property and their ability to use it.
  • The potential compensation that they may be offered by the pipeline company.
  • Their options for fighting the taking in court.

Landowners should also consult with an attorney to discuss their rights and options.

The Permian Highway Pipeline is a major project that will have a significant impact on the landowners in its path. It is important for landowners to understand their rights and to make informed decisions about their property.
